EXTENDED RESPONSIBILITY OF PRODUCERS AND IMPORTERS

It is a set of obligations of a producer and of importers related to a product during all its life-cycle phases aimed at prevention of waste formation from a given product and increase of options of recycling or re-use.

A packaging is a product used for packing the goods, its protection, manipulation, delivery and presentation. Non-returnable items of packaging used for the same purposes shall also be considered to constitute the packaging.

When are you a producer or an importer of a packaging?

 

  1. In case you use packaging for packing goods or in case you fill the goods into the packaging and launch the goods to the market under your trade mark, i.e. packer, filler.
  2. In case you are a person for whom the goods are packed of filled and under the trade mark of which the goods are launched to the market, i.e. you are the ordering party of a packing service.
  3. In case you launch the goods to the market in a different way, i.e. you are an importer and a packer without a trade mark.
  4. In case you as a distributor perform handover (for remuneration or free of charge) of a packaging to the end user for direct packing of the goods, i.e. you are a sales person who provides the packaging for packing of purchased goods (a sac, a PE bag or a paper bag).
  5. In case you use a packaging as a distributor for packing (or filling) of the distributed goods or a part thereof, the so-called service packaging (e.g. PE pots, PS pots, bowls in delis)
  6. In case you launch packaging to the market except for the cases when you supply unused packaging to the persons stated in letter a) to e) or to a person packing/filling goods for the person pursuant to letter b), i.e. you are a producer (an importer) of empty packaging directly to the consumer, not for a direct packing.

Packaging is divided to:

  1. Consumer packaging;
  2. Group packaging;
  3. Transport packaging;
  4. Re-used packaging;
  5. Deposit packaging
What is a deposit packaging?

It is a packaging of the goods where besides the price for the goods also a special monetary amount is charged by sale thereof that is linked to the packaging of the goods (hereinafter referred to as “deposit”). The purpose of the deposit is to ensure return of a used packaging.

In case you are a producer of packaging…

In case you are a producer of packaging and waste from the packaging you launch to the market is a part of the communal waste you can meet your obligations individually if your annual production is less than 100 kg or collectively based on a contract concluded with a Producer Responsibility Organization (PRO) if your production per year is more than 100 kg.

OBLIGATIONS OF PRODUCERS OF SPECIFIED PRODUCTS
  1. Registration in the Register of Specified Products and announcing changes of registered data;
  2. Appointing an authorized representative in case a producer of the specified product does not have a registered office or place of business in the Slovak Republic;
  3. Ensuring material composition of the specified products in compliance with the special part of Act on Waste No. 79/2015 Coll.;
  4. Meeting the information obligation in relation to the public and processor of the specified waste stream in compliance with the special part of Act on Waste No. 79/2015 Coll.;
  5. Ensuring of meeting the goals defined in Annex No. 3 of Act on Waste No. 79/2015 Coll.;
  6. Ensuring manipulation with the specified waste stream within the extent and in a way defined by a special part of Act on Waste No. 79/2015 Coll.;
  7. Ensuring revaluation and recycling of the specified waste stream at least in the extent of obligatory goals and limits of revaluation and recycling for the specified waste stream, stipulated in Annex No. 3 of Act on Waste No. 79/2015 Coll.;
  8. Administration and keeping the records and notification of the Ministry about the data from the records in a defined extent and keeping of reported data (The report of data from the records shall be submitted for the period of a calendar year until the 28th February of the following year);
  9. Meeting the information obligation in relation to the end users of a specified product in compliance with the special part of Act on Waste No. 79/2015 Coll. and in a defined way;
  10. Calculation of their collection and market shares in compliance with the special part of Act on Waste No. 79/2015 Coll. based on the data published by the Ministry on its website;
  11. Ensuring meeting the goals of collection stipulated in Annex No. 3a of Act on Waste No. 79/2015 Coll.

 

By concluding of the contract on fulfilment of specified obligations between a producer of a specified product and the respective Producer Responsibility Organization (PRO), the responsibility of a producer of a specified product for fulfilment of specified obligations shall be transferred to this Producer Responsibility Organization (PRO)
